Oklahoma Requirements for a Valid Last Will & Testament

Under Oklahoma Statutes Title 84, Section 84-41, any person who is at least 18 years old and of sound mind may make a will. “Sound mind” refers to testamentary capacity, meaning the person understands the nature of making a will, knows the general character and extent of their property, and recognizes who their natural heirs are.

For a will to be valid in Oklahoma, it must meet all of the following requirements:

Written form (typed or printed)
Signed by the testator, or by another person at the testator’s direction and in their presence
Witnessed by at least two competent witnesses who sign in the testator’s presence
Witnesses shouldn’t be named beneficiaries; under Oklahoma law, a gift to a witness may be voided if that witness is one of only two witnesses to the will

A self-proving will includes notarized affidavits from the witnesses, which can simplify probate by reducing the need for witness testimony in court. Oklahoma also recognizes holographic wills, which are entirely handwritten, dated, and signed by the testator without witnesses, though formal witnessed wills are generally recommended to reduce complications at probate.

Dying Without a Will in Oklahoma: What Intestate Succession Means

When a Norman resident dies without a valid will, Oklahoma’s intestate succession rules under Okla. Stat. tit. 84, Section 213 determine how assets are distributed. Those default rules are straightforward on paper but can produce outcomes the deceased never intended, particularly for blended families and unmarried partners.

A surviving spouse inherits the entire estate only when the deceased left no surviving children, parents, or siblings. In many family situations, that condition isn’t met. When to Create or Update a Last Will & Testament

A will drafted years ago may no longer reflect a person’s current family, assets, or intentions. Several life events signal that it’s time to create a new will or revisit an existing one:
