Gender-Neutral Custody Standards

Oklahoma law doesn’t give mothers or fathers an automatic advantage in a custody case. Section 112(C)(3)(b) of Title 43 prohibits courts from preferring a custodian because of the parent’s gender. Once legal parentage is established, both parents are evaluated under the same standard.

State law also creates no preference or presumption for joint legal custody, joint physical custody, or sole custody under 43 O.S. §112(C)(2). Courts encourage frequent and continuing contact with both parents when it benefits the child, but the final arrangement depends on the evidence and family circumstances.

Establishing an Unmarried Father’s Parental Rights

An unmarried father may need to establish paternity before asking the court for custody or parenting time. Legal parentage provides the basis for asserting those rights in court. Modification, Safety & Child Preference Issues

Some parental-rights disputes arise after a custody order is already in place. A modification of a sole custody order generally requires a permanent, material, and substantial change in circumstances affecting the child’s welfare, as Oklahoma courts have held. A request should identify the changed circumstances and explain why a different arrangement is appropriate for the child.

Domestic Violence, Stalking & Harassment

A finding of domestic violence, stalking, or harassment creates a rebuttable presumption under Section 109(I) of Title 43 that awarding custody or a shared parenting plan to the perpetrator would harm the child. This legal conclusion applies unless sufficient evidence overcomes it.

When a parent relocates or is absent because of domestic violence committed by the other parent, Oklahoma law provides that the relocation or absence can’t weigh against that parent when parenting arrangements are determined. The court still evaluates the evidence and the child’s welfare.

A Child’s Stated Preference

Under 43 O.S. §113, a court considers a child’s preference about custody or parenting time only when it finds that an interview would serve the child. The preference is one factor in the decision, not the controlling factor. Its significance depends on the circumstances the court is permitted to consider.
