How SoonerCare Long-Term Care Eligibility Works in Oklahoma

Oklahoma’s Medicaid program is called SoonerCare and is jointly funded by the state and federal government. Oklahoma Human Services (OKDHS) administers financial eligibility for long-term care, including nursing facility coverage. Oklahoma is an income-cap state, meaning applicants must have monthly income below the program limit at the time of application rather than spending down excess income to qualify.

As of 2026, the income limit for nursing facility Medicaid is $2,982 per month, equal to 300% of the SSI Federal Benefit Rate. The asset limit is $2,000 per applicant. Applicants whose income exceeds the cap can use a Qualified Income Trust, also called a Miller Trust, to redirect the excess and satisfy the income requirement. Oklahoma Human Services maintains a Cleveland County office in Norman that processes SoonerCare applications and eligibility determinations for area residents.

Oklahoma’s 60-Month Look-Back Period

Oklahoma applies a 60-month look-back period to asset transfers made before a Medicaid application. Any gift or transfer made for less than fair market value during that five-year window can trigger a penalty period of ineligibility. The penalty period begins when the applicant would otherwise be eligible, not when the transfer occurred. That timing means a disqualifying transfer can leave a family with care costs mounting and benefits unavailable. Documentation and sequencing matter considerably.

Several legal strategies can reduce countable assets or protect family wealth from Medicaid’s reach, depending on when planning begins and what assets are involved.

Irrevocable Trusts
A properly structured irrevocable trust can remove assets from Medicaid’s countable resources because the applicant gives up control over them. Timing is critical: the trust must be funded outside the look-back window to avoid a penalty.

Primary Residence Exemption

Medicaid Estate Recovery
Oklahoma’s Medicaid program can seek repayment from a recipient’s estate for benefits paid beginning at age 55, a process called estate recovery. Oklahoma does recognize a hardship exemption: recovery may be waived when it would cause undue hardship to the inheritor. Advance planning can reduce what is subject to recovery.
